Abstract

Justice is understood as a condition in which every individual has an equal opportunity to improve their well-being. Social justice, in turn, is profoundly influenced by the existing structures of power within society, which can be analyzed through political, economic, social, cultural, and ideological perspectives. Justice serves as an essential prerequisite for the realization of an ideal state and constitutes a central concern of democratic governance in achieving societal consensus. This article aims to analyze how Pancasila, as the state ideology, provides a philosophical and normative foundation for the formation of constitutional law within Indonesia’s system of governance. The research employs a library-based qualitative-philosophical approach, combining normative analysis of the texts of Pancasila and the 1945 Constitution (UUD 1945) with theoretical insights from the philosophy of law and Pancasila philosophy. The findings reveal that the values of Pancasila—particularly the Second and Fifth Principles—serve as the moral foundation and normative direction in formulating a national legal system oriented toward social justice. Pancasila functions not only as an ethical guide but also as a conceptual framework for developing laws that ensure equality of rights, uphold humanity, and promote the attainment of public welfare. Thus, Pancasila can be understood as a philosophical basis guiding the realization of justice within Indonesia’s legal system.
