Dampak Globalisasi terhadap Penegakan Hukum dan Perubahan Struktur Sosial Masyarakat Indonesia

Abstract

This paper examines in depth the legal impact and sociological consequences of globalization on law enforcement and changes in the social structure of Indonesian society. The rapid flow of globalization, which includes the migration of capital, technology, and ideology, has created increasing challenges for the judicial system and law enforcement agencies in Indonesia. In the legal context, globalization necessitates legislative reform and the harmonization of domestic regulations with international conventions and treaties, especially in response to transnational crimes such as money laundering, corruption, and cybercrime, which are legally and formally difficult to prosecute and prove.

Furthermore, this paper highlights global demands for the principles of the rule of law and institutional accountability, which encourage openness in the judicial process and guarantee the protection of human rights. Sociologically and legally, globalization triggers the dynamics of social stratification, strengthens legal individualism, and challenges the legitimacy of existing positive law. This phenomenon creates a mismatch between written law and public legal awareness, especially among generations exposed to digitalization.

Indonesia needs an adaptive law enforcement strategy that not only internalizes international legal standards but also maintains local normative authenticity to achieve substantive justice and social and legal stability in the global era.
